Terms of Service

1. Acceptance of these terms

By creating an account, accessing, or using Creavya (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. What Creavya does

Creavya lets you enter a text prompt and generates a short video from it, including AI-generated scenes, narration, captions, and suggested social media titles/captions. Video generation relies on third-party AI providers (including Google's video and language models and, where you supply your own API key, ElevenLabs for voice narration). Output quality, availability, and content are partly outside our control because they depend on these third-party services.

3. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You're responsible for all activity that happens under your account. Tell us promptly if you believe your account has been compromised.

4. Credits, plans, and payment

• The Service is credit-based. Each video generation consumes a set number of credits, disclosed in the product at the time of generation.
• Paid subscription plans renew automatically and grant credits on each successful renewal, until canceled.
• You may also purchase additional credits directly in any quantity.
• All payments are processed by Stripe. We do not store your full payment card details.
• Except where required by law, fees and credit purchases are non-refundable, including for unused credits, partial billing periods, or dissatisfaction with generated output.
• You can cancel a subscription at any time through the billing portal; cancellation stops future renewals but does not refund the current period.
• We may change pricing or credit costs going forward, with notice provided through the Service.

5. Your content and prompts

You retain ownership of the prompts you submit and, subject to the rights of underlying AI providers and applicable law, the videos generated for you. You're solely responsible for the prompts you submit and the content you generate, download, and publish elsewhere (including on TikTok, Instagram, YouTube, or X).

You agree not to use the Service to generate content that is illegal, infringing, defamatory, sexually exploitative of minors, intended to harass or deceive real people, or that violates the terms of the underlying AI providers. We may suspend or terminate accounts that misuse the Service.

6. Third-party services

The Service depends on third-party infrastructure, including Google's AI models for script and video generation, ElevenLabs for narration (using your own ElevenLabs account and key), Supabase for authentication and data storage, and Stripe for payments. Your use of the Service is also subject to those providers' own terms. We are not responsible for outages, changes, or content limitations imposed by these third parties.

7. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that generated videos will be accurate, error-free, suitable for any platform's specific policies, or that the Service will be uninterrupted or secure.

8. Limitation of liability

To the maximum extent permitted by law, Creavya and the individual(s) operating it are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months preceding the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, misuse the Service, or if we discontinue the Service entirely.

10. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the Service is operated, without regard to conflict of law principles.
